Terms of Service
§1. General provisions
- These Terms set out the rules for using the zest.agency website and the free tools made available on it, hereinafter the “Tools”.
- The Tools include in particular: the Consent Mode Checker, the UX Audit and the GA4 Audit.
- Using the website and the Tools means accepting these Terms.
- Personal data processing is described in the Privacy Policy at zest.agency/en/privacy-policy.
§2. Service provider
- The service provider is Zest Sp. z o.o., registered at ul. Szatonia 28A, 95-070 Aleksandrów Łódzki, Poland, tax ID (NIP): 7322206426.
- Contact: info@zest.agency.
§3. Scope of services
- The provider supplies, by electronic means, informational content and Tools that analyse publicly available websites and — in the case of the GA4 Audit — also the settings of a Google Analytics 4 property to which the User voluntarily grants access.
- The Tools are free of charge and require no account.
- Using the Tools requires an internet-connected device and a current browser with JavaScript and cookies enabled.
- A Tool's result is generated automatically and published at a permanent address. That address is not indexed by search engines, but anyone who knows it can open the report — do not share it with unauthorised parties.
§4. Rules of use
- The User undertakes to request scans only of websites they own or have the owner's permission to test.
- Using the Tools in a way that disrupts the provider's website or the analysed websites is prohibited, in particular circumventing scan limits or anti-bot protections.
- The provider applies limits on the number of scans per IP address and per domain, and may temporarily restrict access to the Tools.
- The provider does not guarantee uninterrupted availability of the Tools and may modify or withdraw them.
§5. Connecting a Google account in the GA4 Audit
- The GA4 Audit lets the User voluntarily sign in with a Google account so that the provider can review the settings of the selected Google Analytics 4 property.
- The access scope is read-only. The provider has no technical means to change settings or delete data in the User's property.
- The access token is not stored — it is revoked immediately after the audit runs. Details are set out in §5 of the Privacy Policy.
- The User may revoke the granted access at any time at myaccount.google.com/permissions.
- The configuration audit result is deleted no later than 30 days after it was produced.
§6. Liability
- The Tools are informational. Their results are produced automatically from the state of a website or property settings at the moment of the check, and may not cover every relevant circumstance.
- A result is not legal advice, is not a confirmation of compliance with any regulation including the GDPR, and does not replace an audit performed by a person.
- The User decides whether to make any change to their own website or Google Analytics property and bears responsibility for that decision.
- The provider is not liable for damage arising from use of the Tools to the extent permitted by law, which does not limit consumer rights arising from mandatory provisions.
§7. Complaints
- Complaints about the website or the Tools may be sent to info@zest.agency.
- A complaint should describe the problem and the address at which it occurred.
- The provider handles complaints within 14 days of receipt.
§8. Final provisions
- Matters not covered by these Terms are governed by Polish law.
- The provider may amend these Terms for important reasons, in particular a change to the scope of the Tools or to applicable law. Amended Terms apply from the day they are published on the website.
